Terms & Conditions  

1. Introduction

1.1 These terms and conditions apply to all clients of Joanne Cornish Limited (JCL) trading as The Pilates Hub.

1.2 The address for correspondence is: Joanne Cornish Limited, Suite 3, 44 York Street, Clitheroe, BB7 2DL.

1.3 Joanne Cornish Limited reserves the right to amend these terms and conditions as necessary. Any changes will be communicated with reasonable notice to clients.

2. Pilates Clinic Sessions, Pilates PT sessions and Reformer Classes 

2.1. All Pilates Clinic Sessions, Pilates PT sessions and Reformer Classes are scheduled for 55 minutes. They will take place at the times set out in our schedule or the time you have booked

2.2. We reserve the right to change Reformer class schedules or instructors at any time, and will provide as much notice as possible. We are not liable for any refunds due to such changes. These changes will be notified via email, text message or WhatsApp message.

2.3. We recommend arriving no more than 5 minutes before the Pilates Clinic Sessions, Pilates PT sessions or Reformer class starts.

2.4. If you arrive late for a Pilates Clinic Session or Pilates PT session, we cannot extend the class or provide a refund.

2.5. If you arrive more than 10 minutes late for your Reformer class, you will be refused entry to the class for your own safety, as you will have missed the warm up section of your class and no refunds will be provided.

2.6. Class bookings are non transferrable and you may not assign your place to another person.

2.7. Class places are allocated on a first-come, first-served basis, subject to availability.

2.8. If you fail to follow our reasonable instructions or disrupt the class, we reserve the right to ask you to leave without a refund.

3. Payments

3.1. Payments must be made by bank transfer

3.2. Pilates Clinic and Pilates PT session

3.2.1. All Pilates Clinic Sessions, Pilates PT sessions and Reformer classes must be paid in full at the time of booking.

3.2.2. Block booking payments for Pilates Clinic Sessions and Pilates PT sessions are valid for 3 months from the date of purchase. Unused sessions expire and will not be refunded or carried forward.

3.2.3. Block booking payments are non-refundable and non-transferable.

3.2.4. Payment for the next block of five sessions is required on the day you complete your current block

3.2.5. Sessions will not be confirmed until payment is received. To ensure continuity, and to retain your regular slot, please make payment promptly.

3.2.6. Bookings are not confirmed until full payment has been received

3.3. Reformer classes

3.3.1. Reformer class bookings are valid only for the specific month booked and cannot be carried forward to subsequent months.

3.3.2. Reformer class bookings are non-refundable and not transferable to another person..

3.3.3. Bookings are not confirmed until full payment has been received.

4. Registration and Health & Safety

4.1. New clients are required to complete a health screening and assessment form prior to attending any sessions and periodically thereafter.

4.2. Refusal to complete said form may result in not being able to continue in classes or sessions.

4.3. We are not medical professionals and cannot advise on whether you should join the classes or sessions.

4.4. If you have any health concerns or medical conditions, you must consult with your doctor or another medical professional before participating.

4.5. You agree to notify Joanne Cornish Limited of any medical conditions, injury, illness, or any other condition that may impact your ability to safely perform any exercises at the studio or provided for homework.

4.6. Should we have any concerns about your health or your ability to safely participate, JCL reserve the right to ask you to leave the class or session for your own safety.

4.7. By joining the classes or sessions, you acknowledge that you do so at your own risk, understanding that there may be a risk of personal injury or illness from participation.

4.8. You agree to keeping us updated of your contact details and of emergency contact details.

4.9. Socks must be worn at all times in the studio. Grip socks are mandatory for all reformer classes.

4.10. Clients who arrive without the required footwear will need to purchase socks from the studio to participate in their session.

4.11. Clients will not be permitted to join classes without the appropriate footwear.

5. Initial Consultation and Beginners Sessions

5.1. Clients wishing to join Pilates Clinic and Pilates PT sessions must first attend a one-to-one consultation.

5.2. Clients wishing to join Reformer classes must attend an induction session, either as a one to one or group, or a group beginners course. Exceptions may be made for clients with prior Pilates experience, at the discretion of the instructor.

6. Safety and security

6.1. Clients are responsible for the security of their personal belongings whilst at the studio or any other venue. Joanne Cornish Limited accepts no liability for lost, stolen, or damaged items.

6.2. Joanne Cornish Limited accepts no liability for loss or damage to vehicles while clients are attending sessions.

7. Behaviour and Studio Etiquette

7.1. Clients are expected to behave respectfully towards instructors, staff, and other clients.

7.2. Disruptive or inappropriate behaviour may result in the client being asked to leave the session or studio, without a refund.

7.3. Mobile phones should be on silent or switched off during classes.

7.4. Smoking is not allowed anywhere on the premises.

7.5. Alcohol or drugs must not be consumed prior to or during classes.

8. Cancellations and Rescheduling

8.1. Cancellation policy

8.1.1. Joanne Cornish Limited operates a 48 hour cancellation policy.

8.1.2. Any sessions or classes cancelled without 48 hours notice will be charged at the full rate for that session or class.

8.2. Pilates Clinic and Pilates PT session

8.2.1. Cancellations or rescheduling requests must be made with at least 48 hours’ notice. Notification can be provided by phone, text, or email.

8.2.2. Pilates Clinic and Pilates PT sessions cancelled without 48 hours’ notice will be charged at the full session rate.

8.2.3. A request to reschedule an existing appointment will be taken as a cancellation of that appointment and subject to the 48 hour cancellation policy as outlined in section 8.1 above.

8.2.4. If you fail to attend your scheduled Pilates Clinic and Pilates PT sessions without notice, the session will be treated as a cancellation without 48 hours notice and will be subject to our cancellation policy outlined in section 8.1 above.

8.3. Reformer classes

8.3.1. Cancellations made with at least 48 hours’ notice may be transferred to another class within the same calendar month, subject to availability. Classes cannot be transferred to subsequent months.

8.3.2. Reformer classes cancelled without 48 hours’ notice will not be eligible for transfer to another class.

8.3.3. If you fail to attend your scheduled Reformer class without notice, the session will be treated as a cancellation without 48 hours notice and will be subject to our cancellation policy outlined in section 8.1 above.

9. Liability and Insurance

9.1. All exercises and use of equipment at The Pilates Hub are undertaken at the client’s own risk.

9.2. Joanne Cornish Limited maintains appropriate insurance coverage; however, it is the client’s responsibility to ensure they are medically fit to participate in Pilates sessions.

9.3. Joanne Cornish Limited and its instructors are not liable for injuries sustained due to a client’s failure to disclose relevant health information

9.4. Joanne Cornish Limited and its instructors are not liable for injuries sustained due to a client’s failure to follow instructions.

9.5. Nothing in this agreement shall limit liability for death or personal injury caused by negligence, fraud, or any other matter for which liability cannot be excluded.

9.6. We will provide our services with due care and skill.

9.7. There is no liability for loss of profits, business, goodwill, anticipated savings, goods, contracts, or data, or for any special, indirect, consequential, or economic loss.

9.8. Our total liability will be limited to the total price paid for the services in the 12 months preceding any claim.

9.9. If we are unable to fulfil our obligations due to circumstances beyond our control or due to your actions, we will not be liable for any costs or damages incurred as a result of such delay or prevention.

10. Instructor Substitution

10.1. Joanne Cornish Limited reserves the right to substitute instructors for classes or sessions without prior notice.

11.Data Protection and Privacy

11.1. Joanne Cornish Limited collects and processes personal data in accordance with the UK General Data Protection Regulation (UK GDPR).

11.2. Personal information provided by clients will only be used for the purposes of class bookings, health and safety, and direct communication.

11.3. Client data will not be shared with third parties without prior consent, except where required by law.

11.4. Personal information is kept for a period of 7 years following the last visit.

12.Photography and Marketing

12.1. Joanne Cornish Limited may occasionally take photographs or videos for marketing purposes.

12.2. Clients will be informed in advance and can opt out of being included in any such materials.

13.Intellectual Property

13.1. We own or license all intellectual property rights in the materials and content used in our classes. You may not copy, reproduce, or share any content from the classes without our written consent.

13.2. We grant you a limited, non-exclusive, non-transferable license to use any content provided in the classes solely for the purposes of attending and participating in the classes.

13.3. You may not record any part of the classes without prior written consent from us. We may, at our discretion, record classes for promotional purposes with your permission.

13.4. The copyright in all materials is owned by Joanne Cornish Limited unless otherwise stated.

14.Force Majeure

14.1. Joanne Cornish Limited will not be held liable for any failure to perform our obligations under this agreement caused by circumstances beyond our control, including but not limited to natural disasters, pandemics, government-imposed restrictions, or any other events considered "force majeure.”

15.General Terms

15.1. Failure to enforce any provision of this agreement will not waive our right to do so in the future.

15.2. If any term of this agreement is found to be invalid or unenforceable, the remaining provisions will remain in effect.

15.3. These terms represent the entire agreement between us and supersede any previous agreements, whether oral or written.

15.4. We reserve the right to update or amend these terms at any time. You will be subject to the terms in effect at the time of your booking.

16.Governing Law and Dispute Resolution

16.1. This agreement shall be governed by English law, and any disputes arising from or related to this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.
